Scope of Application
All business transactions between the commissioning person or organisation and PIVARO are governed exclusively by these General Terms and Conditions (GTC). PIVARO is a joint brand of:

- MTraining e.U. (Mathias Cimzar)
The contract is concluded upon booking confirmation by the booking system or by the respective business coach. Deviating terms and conditions shall only be effective if expressly acknowledged in writing by the respective business coach.
Agreements that deviate from or supplement these GTC must be made in writing.
Prices
Price information provided verbally is for non-binding guidance only. Only prices provided in writing can be guaranteed as accurate.
All prices are stated in euros. Private customers (B2C) pay the final price including VAT. Business customers (B2B) pay the net price plus VAT. For cross-border B2B bookings within the EU with a valid VAT identification number, the reverse-charge procedure will be applied.
Booking & Payment
Bookings are made online via the respective business coach’s meetergo booking system. No software installation is required.
Payment Terms for Individuals (B2C)
For individuals, payment is processed via Stripe and the payment methods offered there.
Payment Terms for Organisations/Companies (B2B)
Invoices are issued directly by the respective business coach. The invoice is payable within 14 working days of receipt. In the event of late payment, default interest shall apply at the statutory rate applicable at the payment deadline. Business coach reserves the right to refer outstanding claims to a debt collection agency
Cancellation & Rescheduling
Cancellations up to no later than 24 hours before the agreed appointment are possible free of charge. Payments already made will be refunded accordingly.
For cancellations less than 24 hours before the appointment, 100% of the agreed fee will be charged. Cancellations may be made by email or via the booking system.
If an appointment has to be cancelled by the business coach, an alternative appointment will be offered promptly. Further claims are excluded.
Rescheduling
Business coaching appointments that are rescheduled and made up within 14 days may be rescheduled once free of charge. Thereafter, the cancellation rules apply. Mutually agreed cancellations or postponements will be considered on a case-by-case basis and regulated separately.
Longer-Term Programmes & Packages for B2B Customers
For longer-term business coaching programmes or multi-session packages, separate cancellation rules apply and are stated in the respective offer.
Delivery & Technical Requirements
Participation in online business coaching requires a functioning internet connection as well as suitable hardware and software. PIVARO accepts no liability for technical problems on the part of the coachees.
Responsibilities & Liability
PIVARO is specifically guided by the goals agreed upon in the business coaching. Responsibility for implementing the impulses and achieving personal goals lies with the person being coached.
Disclaimer of Liability
The business coaches of PIVARO assume no warranty for the timeliness, accuracy, completeness or quality of the information provided. Liability claims relating to material or immaterial damage caused by the use or non-use of the information provided, or by the use of incorrect or incomplete information, are generally excluded unless intentional or grossly negligent fault can be proven.
Confidentiality & Non-Disclosure
All information disclosed in the course of business coaching will be treated as strictly confidential. The respective business coach undertakes to maintain the strictest confidentiality regarding all known or subsequently disclosed business, operational or personal matters of the commissioning person or organisation, including beyond the end of the contractual relationship. This applies in particular to electronically processed information and data.
The duty of confidentiality does not apply in the case of:
- Consent of the coachee
- Legal obligation to disclose
- Risk of harm to self or others
- Information about an introductory meeting already held with one of the business coaches
Copyright & Intellectual Property
All documents, materials and content provided in the course of business coaching are and remain the intellectual property of the respective business coach, thereby establishing sole copyright.
Rights of Use
These documents are made available exclusively to the person being coached for personal use. Unless otherwise agreed in writing, the commissioning person or organisation is granted a geographically unrestricted right of use for the duration of the contractual relationship.
Prohibited Use
The following uses are prohibited:
- Disclosure to third parties (including within the company, except in the case of B2B agreements)
- Commercial use
- Reproduction without prior written consent
- Publication in any form
Miscellaneous
Severability Clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Contact for complaints: info@pivaro.at
Place of Jurisdiction & Applicable Law
Due to the registered offices of the companies, Vienna shall be the place of jurisdiction. Austrian law shall apply exclusively, without prejudice to mandatory consumer protection provisions at the place of residence of private individuals in the case of B2C transactions.
